Terms and Conditions

You can pay using the payment methods made available at checkout.

Payment takes place through Shopify and/or the payment provider engaged by Brayne & Co. at that time.

Brayne & Co. may change the available payment methods.

Any payment terms are shown before you complete your order.

At launch, we deliver to consumers in the Netherlands and Belgium.

Orders are normally processed within 1–2 business days.

Expected delivery time is 1–2 business days after shipment within the Netherlands and 2–3 business days in Belgium.

If no other timeframe has been agreed, we deliver without undue delay and within the statutory maximum term.

Delivery takes place at the address you have provided.

The risk of loss or damage generally does not transfer until you, or a third party designated by you, physically receives the product.

We charge €5.95 for the Netherlands and €7.95 for Belgium per order, unless a different temporary promotion is stated at checkout.

Standard shipping to the Netherlands and Belgium is free for orders of €50.00 or more.

The shipping costs shown at checkout are decisive.

As a consumer, you generally have 14 days from receipt of the product to withdraw from the contract without giving a reason.

You can do this via the electronic withdrawal function on our website or via another unambiguous statement to Brayne & Co.

After notifying us of your withdrawal, you have 14 days to return the product.

The right of withdrawal does not apply in cases where the law provides an exception.

For Brayne & Co., it is particularly relevant that this right can lapse for sealed products that are not suitable to be returned for reasons of health protection or hygiene once the seal has been broken after delivery.

We apply this exception only when the statutory conditions are met.

The direct costs of a standard return after withdrawal are borne by the consumer.

The consumer is only liable for any depreciation resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.

We will refund the amounts due no later than within the statutory term.

In case of full withdrawal, we will also refund the cost of our cheapest standard delivery to you.

We may wait to refund until we have received the products or until you have provided proof of return, whichever comes first.

Brayne & Co. warrants that products delivered comply with the contract and have the characteristics the consumer may reasonably expect under the contract.

Statutory rights in respect of a non-conforming product are not limited by these terms.

Complaints can be submitted via support@brayneco.com.

We aim to respond substantively within 14 days.

If a complaint requires more time, we will inform you accordingly.

Brayne & Co. may display customer product reviews on the website.

Reviews are not edited in substance by us to create a more positive impression.

We do not use fictitious reviews and do not present paid or otherwise incentivized reviews as independent customer reviews.

Where technically possible, we make clear how reviews were collected or verified.

A review may be removed if, for example, it is unlawful, contains third-party personal data, is offensive or discriminatory, contains spam, or demonstrably does not relate to the reviewed product or service.

Brayne & Co. is not liable for damage to the extent it results from incorrect use of a product, use contrary to clear instructions, or circumstances reasonably beyond our control.

Nothing in these terms excludes or limits liability to the extent such exclusion or limitation is not permitted under mandatory law.

When performance is temporarily impossible or unreasonably burdensome due to circumstances beyond our reasonable control, obligations may be suspended for as long as that situation continues.

This does not affect consumers' statutory rights in case of non-delivery or late delivery.

All intellectual property rights in the website, brand name, logos, texts, photography, graphic design and other content of Brayne & Co. belong to Brayne & Co. or its licensors.

Without prior consent, this content may not be copied, distributed or used commercially, except as permitted by law.

We process personal data in accordance with our Privacy Policy and Cookie Policy.

Dutch law applies to the contract.

This choice of law does not deprive a consumer residing in another country of the protection afforded by mandatory consumer rules that remain applicable under the law of that country.

The parties will first try to resolve a dispute by mutual agreement.

If that does not succeed, the dispute may be submitted to the competent court under the applicable statutory rules.

A consumer retains all rights to approach the competent court in their country of residence to the extent provided by law.

We may change these terms for future orders.

An order is governed by the terms in effect at the time the order was placed.
